a small suggestion, from a non-lawyer....

based upon my less than professional understanding of the law, inorder for
fruad to occur, you have to reasonably be expecting to get something that
you are not, based upon things that the seller said, that he knows to be
untrue. You cant very well claim you were mislead if you 'KNOW' the material
to be of terrestrial origin prior to starting the transaction.

If you want to nail this sucker, the best way is going to be to bid on one
of his auctions, pay for the item, have it analyzed, and then proceed from
there. If you start trying to back out of the transaction before having hard
proof of shenanigins based upon what you saw on some email list about this
seller, you are the one who is acting questionably, trying to back out of a
bid on ebay. When you know issues ahead of time, you are supposed to handle
them with the seller before placing a bid. After you win an auction, per
ebay rules, you are obligated to pay for it. No sense taking a chance
getting yourself in trouble, trying to catch this guy..
