No doubt McDonald's made the same "mistake" that the rest of humanity did - believing that our legal system and litigious society could not possibly be so far out of whack as to take something like that seriously. Take a look at the proliferation of even-MORE-bizarre lawsuits, if proof is needed how far the pendulum has swung......and they all owe a debt of gratitude to the success the McDonald's suit had, making such astions mainstream rather than fringe.
