If one has any doubt about the lack of humanity, and the respect for such regarding the Taliban all one needs to do is see what is happening in Afganistan.

And this is the mindset that we are dealing with. Courts will not handle this, sheer force, military might, rounding up the leaders for trials on charges of "crimes against humanity" will.
